Interaction of FMLA and Employee Benefit Plans

This program has been approved for one hour of CE in Missouri and Kansas.

Needless to say, it is absolutely imperative for employers to make sure they are taking the necessary steps to comply with the ACA reporting requirements.

It’s equally important for smaller organizations who think they aren’t subject to the reporting requirement to make sure they are counting their employee correctly.

Big or little, we all have work to do. Our speaker will review FMLA requirements and discuss which employers have to comply and which are protected; benefits during FMLA leave; interaction with STD benefits; cafeteria plan issues; interaction of FMLA and COBRA; and interaction of FMLA with ADA.

Our speaker will be Julie Athey, J.D., Director of Compliance Benefits and HR, The Miller Group. She provides in-depth, hands-on compliance advice and counseling for HR professionals in a variety of industries. She has also conducted numerous workplace investigations regarding complaints of harassment, discrimination, and other misconduct.

Julie's areas of expertise include:

  • Affordable Care Act requirements for employer-sponsored group health insurance
  • Family and Medical Leave Act and similar leave laws
  • Americans with Disabilities Act
  • Wage and hour (employee classification, compensable work hours, calculating overtime)
  • HIPAA portability and privacy
  • ERISA compliance for health and welfare benefits
  • Development of HR policies and procedures, including customized handbooks for employers

Prior to joining The Miller Group, Julie wrote extensively on a variety of employment law and human resources topics. She is also a frequent presenter at seminars and audio conferences for HR professionals. Julie is actively involved in developing compliance tools and strategies for ACA compliance for The Miller Group's benefits clients.
